These Terms of Service ("Terms") govern your use of the DocuFinch software and services. By using DocuFinch, you agree to these Terms.
1. Definitions
- "Service" refers to the DocuFinch managed cloud platform at app.docufinch.com
- "Software" refers to the open-source DocuFinch codebase available on GitHub
- "User" refers to any individual or organization using the Service or Software
- "We", "us", "our" refers to DocuFinch
2. Open Source License
The DocuFinch software is released under the MIT License. You are free to use, modify, and distribute the software in accordance with the MIT License terms. The managed cloud service is subject to additional terms described below.
3. Account & Access
- You must provide accurate information when creating an account
- You are responsible for maintaining the security of your account credentials
- You must be at least 18 years old to create an account
- One person or organization may not maintain more than one free account
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to disrupt, overload, or interfere with the Service
- Access other users' accounts or data without authorization
- Use the Service to store or transmit malicious code
- Resell the managed cloud service without written permission
5. Your Data
- You retain all ownership rights to data you enter into DocuFinch
- We do not claim any intellectual property rights over your content
- You can export all your data at any time in standard formats
- Upon account termination, we will delete your data within 30 days unless legally required to retain it
6. Service Availability
DocuFinch is currently in alpha. The managed cloud service is provided on a best-effort basis. While we aim for high availability:
- We do not guarantee uninterrupted service during the alpha period
- We may need to perform maintenance or updates that temporarily affect availability
- We will make reasonable efforts to notify users of planned downtime
7. Pricing & Payment
- Community edition: Free forever, MIT licensed
- Pro & Enterprise: Pricing as published on our website. We reserve the right to adjust pricing with 30 days notice.
- All prices are in Euros (€) and exclude applicable taxes
8. Limitation of Liability
To the maximum extent permitted by applicable law:
- DocuFinch is provided "as is" without warranties of any kind
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the 12 months preceding the claim
- DocuFinch is a safety management tool, not a substitute for professional EHS advice. You remain responsible for your organization's safety compliance.
9. Termination
- You may close your account at any time
- We may suspend or terminate accounts that violate these Terms
- Upon termination, your right to access the managed service ends, but you retain all rights to the open-source software under the MIT License
10. Governing Law
These Terms are governed by the laws of the European Union and the member state in which DocuFinch is established. Any disputes will be resolved in the competent courts of that jurisdiction.
11. Changes to Terms
We may update these Terms. Material changes will be communicated via email (for registered users) and posted on this page with an updated date. Continued use of the Service after changes constitutes acceptance.
